Please read these Terms of Service ("Terms") carefully before accessing or using our website, OCTOBONBON.CO.UK (the "Service"), operated by OCTOBONBON® - trading as OCTOBONBON ("us", "we", or "our").

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions, including those additional terms and policies referenced herein.

SECTION 1 - GENERAL CONDITIONS

1.1 Acceptance of Terms

These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and/or contributors of content. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

1.2 UK Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

1.3 Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. We shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages resulting from the use of the Service or any products procured using the Service.

SECTION 2 - PRODUCTS, ORDERS, AND CONTRACT

2.1 Our Products

We sell customisable pick 'n' mix sweet pouches, which we refer to as "Cosmic Delights" or "Relic Drops" (the "Products"). All Products are subject to availability. We reserve the right, but are not obligated, to limit the sales of our Products to any person, geographic region, or jurisdiction.

2.2 Product Accuracy

We have made every effort to display as accurately as possible the colours and images of our products. We cannot guarantee that your computer monitor's display of any colour will be accurate. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.

2.3 Allergen and Dietary Information

It is the customer's responsibility to review the allergen information provided for each sweet before adding it to their custom pouch.

  • While we take reasonable steps to prevent cross-contamination, all Products are handled in an environment that processes common allergens, including (e.g., WHEAT, MILK, NUTS, PEANUTS, SOY).
  • If you have a severe allergy, you should not purchase our Products. We cannot guarantee a completely allergen-free environment.

2.4 Formation of Contract (The Sale)

Your order confirmation is an acknowledgement that we have received your order request. A legally binding contract between you and Octobobon is formed only when we dispatch the Products to you, not before. We reserve the right to refuse any order placed.

SECTION 3 - PRICING, PAYMENT, AND DELIVERY

3.1 Pricing

All prices shown on the website are in Great British Pounds (£) and include Value Added Tax (VAT) at the current UK rate, where applicable.

3.2 Payment

We use Shopify Payments and other third-party payment processors (e.g., PayPal) to process payments. We are not responsible for the security of these third-party payment processors. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.

3.3 Delivery

  • Delivery timescales are estimates only. We are not responsible for delays outside of our control (such as postal service delays or extreme weather).
  • Risk of loss and damage of the Products passes to you upon delivery.
  • The delivery cost for your order is calculated at checkout and will be free on orders over £30 (excluding discounts), as advertised.

SECTION 4 - UK CONSUMER RIGHTS AND RETURNS

4.1 Statutory Rights (Faulty Goods)

Your rights under the Consumer Rights Act 2015 remain fully protected. If the Products are delivered damaged, faulty, or not as described, you have the right to a refund, repair, or replacement. You must notify us of such issues within 48 hours of delivery with photographic evidence, as outlined in our separate Returns and Refunds Policy.

4.2 Custom and Perishable Exemption (Change of Mind)

Pursuant to Regulation 28 of the Consumer Contracts Regulations 2013, our Products are exempt from the standard 14-day "cooling-off period" return right.

  • Our sweet pouches are customised (made to your unique specification).
  • Our Products are perishable food items.
  • Therefore, we do not accept returns or offer refunds for non-faulty Products if you simply change your mind.

4.3 Policy Location

This section must be read in conjunction with our Returns and Refunds Policy, which provides full details on how to handle damaged or faulty goods.

SECTION 5 - WEBSITE USE AND INTELLECTUAL PROPERTY

5.1 Intellectual Property

The OCTOBONBON name, logo, mascot design, the concepts of "Relic Drops," "Celestial Vault," and all content on this site (text, graphics, images) are the property of Octobonbon® and are protected by copyright laws. You are prohibited from reproducing, duplicating, copying, selling, or exploiting any portion of the Service without express written permission from us. Octobonon is a registered trademark.

5.2 Prohibition on Use

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.
